Public-Private Partnership

Public-private partnership (PPP) is a long-term and mutually beneficial form of cooperation between the state and a private partner-investor. PPP is currently a dynamically developing and priority area at K&A. The team of lawyers developing this PPP practice is unique in that it is a pioneer in this field. For example, K&A lawyers were the first in the country’s history to prepare and implement the first PPP project for hemodialysis services in the Kyrgyz Republic, from the preparation of a feasibility study, organizing and conducting a tender to select a private partner, to the signing of the PPP agreement with the private partner. In addition to project work, PPP lawyers participate in the legislative process. Specifically, with their direct support, the current PPP law, the draft of a new PPP law, and current bylaws related to PPPs were developed.

Today, K&A lawyers are ready to offer professional legal services at any stage of a PPP project, from its initiation to its final stage, including:

  • Legal support for PPP projects from the initiation stage to their full completion, including the tender process and negotiations between the public partner and the tender winner;
  • Preparation and structuring of PPP projects;
  • Conducting legal due diligence of PPP projects;
  • Assessing the viability of a PPP project and identifying legal risks, as well as ways to minimize or eliminate them;
  • Developing tender documents, draft PPP agreements, and other documents necessary for conducting the tender and selecting a private partner for the PPP project;
  • Cooperating with state and municipal authorities to improve legislation and practice in the field of PPP;
  • Legal support on many other issues that may arise during the preparation and implementation of a PPP project.
